Indiana has reported several foreclosure scams where fake mortgage foreclosure consultants try and get distressed homeowners to pay high fees for services that do not yield a positive result.
December 01, 2011 /24-7PressRelease/ -- Indiana Homeowners Facing Foreclosure: Are You Being Scammed?
In these tough economic times, many people are struggling to make ends meet. They may find themselves without enough money to make monthly payments on homes, credit cards, vehicles and other debts. Indeed, house payments can pose major challenges because a mortgage is the biggest expense for most people.
In 2010, Indiana ranked 18th among all states in foreclosure rates. If you are a homeowner facing possible foreclosure, it is only natural to seek any available help to prevent the loss of your home. But beware of so-called mortgage foreclosure consultants that exploit homeowners looking for expert guidance to protect themselves from foreclosure. Relying on such companies can worsen an already distressing situation. You may pay high fees for services that do not yield a positive result, and when you ask for your money back, you may not have any protection.
Indiana Attorney General Sues Mortgage Foreclosure Consultant Company
On September 26, 2011, the Indiana Attorney General's Office sued a California-based mortgage foreclosure consultant company called Premier Legal Advocates and its owner, Brian Pascal. The complaint, filed on behalf of homeowners in seven different Indiana counties, alleges the defendants:
-Failed to inform homeowners of their legal rights when facing foreclosure
-Failed to advise homeowners about the availability of nonprofit credit counseling
-Illegally collected up-front fees from homeowners prior to providing assistance
-Failed to register a surety bond with the Indiana Attorney General's Office -- which are bonds intended to protect consumers from companies that do not deliver services as promised and then refuse to refund consumers' money
These alleged consultants do not adequately serve the needs of their customers facing foreclosure. Contact an experienced bankruptcy attorney to protect yourself from companies that pose as consultants who say they'll assist you through tough financial times, but who don't deliver on their promises.
