Can Employers in Oregon Check Your Credit History? -- A Fiery Debate
Oregon recently passed legislation barring most companies from using credit checks as part of their hiring criteria.

With consumer bankruptcy filings on the rise, a high unemployment rate, and people struggling to make mortgage payments, landing and keeping a job is more important than ever. Unfortunately, those most needing employment are finding it harder and harder to do so.

Many employers look at a job applicant's credit history and reject a candidate using their credit rating, outstanding debt or past bankruptcy filings as factors. This practice has sparked a national debate on whether employers can legally obtain credit reports and use them during the hiring process.

Although there are compelling arguments on both sides, Oregon recently voiced its opinion and barred most companies from using credit checks as part of their hiring criteria.

Oregon Joins the Crowd

Although the Fair Credit Reporting Act prohibits employers from basing a hiring decision solely on an applicant's credit report, several states found it necessary to place further restrictions on employers.

Oregon's new law, however, does not apply to all companies. Exceptions include federally insured banks, certain credit unions, law enforcement agencies, and those required by law to check credit histories.

Additionally, credit checks will be allowed if a job's essential function requires access to financial information, thus making a credit check substantially job-related.

Both Sides Debate

Employers contend there are several reasons why they look at an applicant's credit history:
-Financially troubled individuals pose a higher risk when dealing with client funds
-Money issues may lead to relationship problems, making it less likely an applicant can focus at work
-Credit reports provide insight into an applicant's accountability and performance

Conversely, many people feel looking at candidate credit reports is unfair and unfounded. A person may fall behind on bills due to unforeseeable medical expenses or loss of a job. In these instances it is unfair to hold such occurrences against someone as it has no bearing on a candidate's ability to do their job properly.

Filing for bankruptcy can save family homes, stop harassing creditors from calling, and provide peace of mind for financially troubled individuals.
