Misiti Global Receives J-1 Residency Waiver For Client
Certain J-1 exchange visitors are subject to a two-year physical presence requirement which requires that they return to their home country for at least two years at the end of the program.
NEW YORK, NY, October 28, 2011 /24-7PressRelease/ -- Another name for this is the foreign residence requirement under U.S. law, Immigration and Nationality Act, section 212(e). If a person is unable to return to their home country to fulfill the two-year requirement, they must obtain a waiver approved by the Department of Homeland Security.
There are 5 bases for a J-1 waiver. They are :
o No Objection Statement;
o Request by an Interested U.S. Federal Government Agency;
o Persecution;
o Exceptional Hardship to a U.S. Citizen (or lawful permanent resident) Spouse or Child of an Exchange Visitor; and
o Request by a Designated State Public Health Department or its Equivalent (Conrad State 30 Program).
Recently Misiti Global was approached by a physician from Norway who was required to return to his country to fulfill the 2 year residency requirement of his J-1 Visa. However, during the time he was in the US he met a US citizen, fell in love, and the two married. Misiti Global reached out to the Norwegian embassy and requested a no objection letter. After numerous conversations the embassy agreed to provide the no objection letter and Misiti Global, PLLC was able to procure a waiver of the J-1 residency requirement for the client. They than filed the marriage based petition and the client received his employment authorization in 3 months and his green card in six months.
